Digital Millennium Copyright Act (DMCA) Policy

1. Introduction

This Digital Millennium Copyright Act (DMCA) Policy (the "Policy") applies to all users of NGMATTERS.COM (the "Platform") operated by VIJOTECH LLC (the "Company"), including users who create and post content on the Platform. The Policy is designed to protect the copyrights of the Company, the Platform, and the users of the Platform, and to comply with the DMCA.

2. Definitions

For the purposes of this Policy, the following terms shall have the following meanings:

  • "Content" means any and all materials posted on the Platform, including text, images, videos, audio files, and software.
  • "Copyright" means the exclusive rights granted to the owner of a copyrighted work under the United States Copyright Act, including the right to reproduce, distribute, perform, display, and prepare derivative works of the copyrighted work.
  • "DMCA" means the Digital Millennium Copyright Act, 17 U.S.C. ยง 1201 et seq.
  • "Infringing Content" means any Content that infringes the copyrights of the Platform, the owners of the Platform, or any other party.

3. User Responsibility

Users are responsible for the Content they create and post on the Platform. Users must not post any Content that infringes the copyrights of the Platform, the Company, or any other party. If a user posts Infringing Content, the Platform may remove the Infringing Content and terminate the user's account.

4. DMCA Takedown Procedure

If you believe that your copyrighted work has been used on the Platform in a way that constitutes copyright infringement, you may submit a DMCA takedown notice to our designated Copyright Agent ("Copyright Manager"). The takedown notice must be in writing and must include the following information:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material.
  4. Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an email address.
  5. A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

The Platform will review the takedown notice and, if the Platform believes that the Infringing Content is infringing the copyrights of the copyright owner, the Platform will remove the Infringing Content from the Platform.

5. Counter-Notification Procedure

If you believe that your content was removed or access to it was disabled and is not infringing, or if you have the right to post the material, you may send a counter-notification to our designated Copyright Agent. The counter-notification must be in writing and must include the following information:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled.
  3. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number.
  5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, the Northern District of California, and that you will accept service of process from the person who provided the original notification or an agent of such person.

The Platform will review the counter-notification and, if the Platform believes that the Content was removed in error, the Platform will restore the Content to the Platform.

6. Repeat Infringers

The Platform may terminate the accounts of users who repeatedly post Infringing Content.

7. Governing Law

This Policy is governed by and construed in accordance with the laws of the State of California.

8. Entire Agreement

This policy, our Terms of Use, our Privacy Policy, and our AI Use Policy and Transparency Notice constitute the entire agreement between the Company and its users with respect to the use of the Platform and its Services.

9. Severability

If any provision of this Policy is held to be invalid or unenforceable, such provision shall be struck from this Policy and the remaining provisions shall remain in full force and effect.

10. Waiver

No waiver of any provision of this Policy shall be effective unless in writing and signed by an authorized representative of the Platform.
